Jack C. Phillips, confeiteiro, cristão convicto, havia se recusado a fabricar um bolo para a ocasião da celebração de um casamento homoafetivo, por entender que o aceite da encomenda implicaria em endosso à prática social tida como contrária às suas crenças religiosas, o que resultou na condenação perante a Comissão de Direitos Civis do Estado do Colorado. Considerando que episódios similares são recorrentemente levados à apreciação jurisdicional, o presente estudo ocupa-se do caso Masterpiece Cakeshop, Ltd. v. Colorado Civil Rights Commission (2018), julgado pela Suprema Corte dos Estados Unidos. A partir da revisão bibliográfica e da jurisprudência, constata-se que o caso permite, por um lado, compreender o dilema enfrentado pelos objetores de consciência na sociedade secular pós-moderna e, por outro lado, entender as diretrizes para a resolução de conflitos futuros lançadas com a decisão da Suprema Corte estadunidense
